29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 21218 West 47th Terrace Shawnee, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling TAMKO Heritage architectural asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant and gasoline. The chemical hazards associated with these chemicals include skin, eye and respiratory irritation, redness, itching and burning, may cause an allergic skin reaction, drowsiness and/or dizziness, is suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 21218 West 47th Terrace Shawnee, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for TAMKO Heritage architectural asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant and gasoline at the job site. The chemical hazards associated with these chemicals include skin, eye and respiratory irritation, redness, itching and burning, may cause an allergic skin reaction, drowsiness and/or dizziness, is suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.
