29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501   a) Burgeon Construction does not maintain a program, including frequent and regular inspections by competent persons designated by the employer, to ensure that workers use fall protection in compliance with 29 CFR 1926.500 to 1926.503.  To abate this item the employer must initiate and maintain a program, including frequent and regular inspections by competent persons it designates, to ensure that workers use appropriate fall protection.  This condition was most recently observed on July 30, 2024, at the 3903 South 25th East, Idaho Falls, ID jobsite.  Employees performing framing activities were not using fall protection correctly and were exposed to a 10-foot fall hazard from an exterior top plate to the ground below.   Burgeon Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1592057, citation number 1, item number 5, and was affirmed as a final order on December 1, 2022, with respect to a workplace located at 1764 Merlin Court, Sparrow Hill, Idaho Falls, ID 83401.   Note) Pursuant to 29 CFR 1903.19, Burgeon Construction, LLC must submit certification of corrective actions for these items along with documentation of specific actions taken to ensure the proper use of fall protection is required, identified, and consistently enforced by supervisors on all current and future worksites.  This includes the names and qualifications of the persons it is designating as competent and a description of their responsibilities.
