29 CFR 1926.102(b)(1)(i): Protective eye and face protection devices did not comply with consensus standard; ANSI/ISEA Z87.1-2010, Occupational and Educational Personal Eye and Face Protection Devices, incorporated by reference in � 1926.6:  a) On July 31, 2024, an employee performing framing activities used a pneumatic nail gun without wearing protective eyewear.   Burgeon Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.102(a)(1), which was contained in OSHA inspection number 1592057, citation number 1, item number 2 and was affirmed as a final order on December 1, 2022, with respect to a workplace located at 1764 Merlin Court, Sparrow Hill, Idaho Falls, ID 83401.   Note) Certification and documentation of corrective actions are required for this item.

29 CFR  1926.304(h)(1): Each circular crosscut table saw was not guarded by a hood that meets all the requirements of paragraph (i)(1) of this section for hoods for circular ripsaws:  a) On July 31, 2024, employees used a 10-inch DeWalt table saw with the upper blade guard removed.  Burgeon Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.304(i)(1), which was contained in OSHA inspection number 1592057, citation number 1, item number 3b, and was affirmed as a final order on December 1, 2022, with respect to a workplace located at 1764 Merlin Court, Sparrow Hill, Idaho Falls, ID 83401.   Note) Certification and documentation of corrective actions are required for this item.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501.  Burgeon Construction does not maintain a program, including frequent and regular inspections by competent persons designated by the employer, to ensure that workers use fall protection in compliance with 29 CFR 1926.500 to 1926.503 (subpart M).  To abate this item the employer must initiate and maintain a program, including frequent and regular inspections by competent persons it designates, to ensure that workers use appropriate fall protection.   These conditions were most recently observed as described below:  a) On July 31, 2024, at the 201 East Ross Ave, Driggs ID, jobsite.  An employee performing framing activities was not using fall protection correctly and was exposed to a 20-foot fall hazard from the exterior top plate to the ground below.   b) On July 31, 2024, at the 201 East Ross Ave, Driggs ID, jobsite.  An employee performing framing activities was not using fall protection and was exposed to an approximate 11-foot fall  hazard from an interior truss to the floor below.    c) On July 31, 2024, at the 201 East Ross Ave, Driggs ID, jobsite.  A guardrail was not in place along an open-sided floor used for access to the second floor.  Employees were exposed to a 10-foot fall the lower level.     Burgeon Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1592057, citation number 1, item number 5, and was affirmed as a final order on December 1, 2022, with respect to a workplace located at 1764 Merlin Court, Sparrow Hill, Idaho Falls, ID 83401.
