29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  At a worksite located at 1009 Wilds Parkway, Greenwood, MO, employees were exposed to struck by hazards.  The employer exposed the employees to these hazards by allowing them to work without protective helmets in an area where there was a possible danger of head injury from impact due to potential falling objects.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At a worksite located at 1009 Wilds Parkway, Greenwood, MO, employees were exposed to fall hazards.  The employer exposed the employees to these hazards by allowing them to use a portable extension ladder to access an upper landing surface when the side rails of the ladder did not extend at least 3 feet above the level to which it was being used to gain access, nor was the ladder secured to the structure with a grasping handle available for employee use.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  At a worksite located at 1009 Wilds Parkway, Greenwood, MO, employees were exposed to struck by hazards that could cause eye and face injuries.  The employer exposed the employees to these hazards by allowing them to utilize a pneumatic nail gun without the use of eye protection.   Leiva Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1690615, citation number 1, item number 1 and was affirmed as a final order on 11/09/2023, with respect to a workplace located at 21510 8th, Terrace, Shawnee, Kansas.   Leiva Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1644949, citation number 1, item number 1 and was affirmed as a final order on 7/05/2023, with respect to a workplace located at 3109 SW Merriam Drive, Lee's Summit, MO, 64081. 29 CFR  1926.501(b)(13):Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   At a worksite located at 1009 Wilds Parkway, Greenwood, MO, employees were exposed to fall hazards.  The employer exposed the employees to these hazards by allowing them to perform construction work at heights greater than 6 feet without the use of fall protection.  Instances of exposure include but are not limited to:  1.  One employee exposed to falls greater than 10 feet while performing construction work on the second level of the structure near the southeast corner of the level.   2.  Two employees exposed to falls greater than 8 feet while performing construction work on the second level of the structure near the center of the level.  3.  One employee exposed to falls greater than 9 feet while performing construction work on the second level of the structure near the northern section of the level.   Leiva Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1679547, citation number 1, item number 1 and was affirmed as a final order on 11/17/2023, with respect to a workplace located at 1611 SW Arbormist Drive, Lee's Summit, MO.
