29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) HD Exteriors, LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of September 23, 2024.  Citation 1, Item 2 a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of September 23, 2024.  Citation 2, Item 1 a repeat violation of 29 CFR 1925.501(b)(13) with an abatement date of September 4, 2024.  Citation 2, Item 2 a repeat violation of 29 CFR 1926.503(a)(1) with an abatement date of September 23, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about August 12, 2024, at 10402 S Rosemont Lane, Oak Creek, WI 53154, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.

29 CFR  1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  (a) On or about August 12, 2024, at 10402 S Rosemont Lane, Oak Creek, WI 53154, the employer did not ensure employees conducting installation of a new residential roof, using hand tools and nail guns were wearing eye protection. This exposed the employees to struck by hazards and eye injuries.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about August 12, 2024, at 10402 S Rosemont Lane, Oak Creek, WI 53154, employees installing a roof on a residential home roof with an approximately 10:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 9 feet 8 inches from the roof eve to the ground below on the back (East) side of the home.  HD Exteriors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1636859, citation number 2, item number 1 and was affirmed as a final order on February 14, 2024, with respect to a workplace located at 259 Thomas Trail in Oconomowoc, WI 53066.  HD Exteriors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1598323, citation number 2, item number 1 and was affirmed as a final order on August 2, 2022, with respect to a workplace located at 2844 Fox Lake Circle, Unit 101, Waukesha, WI 53189.  HD Exteriors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1568611, citation number 1, item number 1 and was affirmed as a final order on April 21, 2022, with respect to a workplace located at 1767 Derby Lane in Oconomowoc, WI 53066.
