29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) German Gutierrez DBA Anderson Construction, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a repeat violation of 29 CFR 1926.501(b)(13) with an abatement date of September 30, 2024.  Citation 2, Item 1 a Other-Than-Serious violation of 29 CFR 1926.503(b)(1) with an abatement date of October 18, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about September 10, 2024, at 351 E. Elm Rd, Oak Creek, WI 53154, employees installing a roof on an existing residential home roof with an approximately 10:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 18 feet 2 inches from the roof eve to the ground below on the back (south) side of the home.  German Gutierrez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1457971, citation number 1, item number 1 and was affirmed as a final order on June 12, 2020, with respect to a workplace located at 501 Samuels Ave., Fort Worth, TX 76102.
