29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a)  On or about October 1, 2024, at 10310 South Shepard Avenue, Oak Creek, WI 53154, the employer did not ensure employees were protected by a protective helmet.  Employees were exposed to a possible danger of head injury from impact or from falling or flying objects, while working below employees installing roofing material from the one story roof of an existing residential property.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a)  On or about October 1, 2024, the employer did not ensure that employees using pneumatic nail guns were wearing eye protection equipment, exposing the employees eyes to a struck-by and impalement hazard.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a ) On or about October 1, 2024, the employer did not ensure the Gorilla portable extension ladders used by employees to access the roof of the residential home extended at least three feet above the upper landing, exposing employees to a fall hazard of approximately 9 foot fall to the ground below.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about October 1, 2024, at 10310 South Shepard Avenue, Oak Creek, WI 53154, employees installing a roof on an existing residential home roof with an approximately 7:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately nine (9) feet from the roof eve to the ground below on the front and back sides of the home.  German Gutierrez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1457971, citation number 1, item number 1 and was affirmed as a final order on June 12, 2020, with respect to a workplace located at 501 Samuels Ave., Fort Worth, TX 76102.

(a) On or about October 1, 2024, at 10310 South Shepard Avenue, Oak Creek, WI 53154, the employer did not verify fall protection training by preparing a written certification record for employees tasked with installing a roof on a residential home.
