29 CFR 1910.134(d)(3)(i)(B)(1): The employer did not select a respirator for employee use that maintained the employee's exposure to the hazardous substance, when measured outside the respirator, at or below the maximum use concentration: Assembly Area: On or about September 25, 2024, while grinding and sanding concrete floor sections approximately 50 feet by 20 feet in area, employees were exposed to respirable silica dust due to not wearing a respirator or not wearing a respirator with appropriate filter cartridges. Employees were provided with a tight-fitting 3M Half Face Respirators with 3M 6001 Organic Vapor Cartridges.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. Assembly Department: On or about September 25, 2024, the employer did not fully and properly implement the engineering controls specified for the task on Table 1 (xiii), while employees were operating floor grinders and sanders on concrete floors with a walk-behind floor grinder that did not have a dust collection system and was not equipped with an integrated water delivery system as required by Table 1. The employer did not perform an exposure assessment to determine exposure to respirable crystalline silica and appropriate respiratory protection to reduce risk of respiratory illness and silicosis.
