OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with scaffold collapse due to failure of the scaffold components:  (a) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, employees were exposed to crushing, struck-by, and fall hazards while performing work from an elevated 2-point suspension scaffold swing stage equipped with OZ Lifting Product 1-ton gear trolleys Model: #0Z1GBT.  The trolleys that were connected to the I-beams and the scaffold platform were not designed to be used as personnel lifting devices.

29 CFR  1926.451(d)(3)(ix): Tiebacks were not secured to a structurally sound anchorage on the building or structure:  (a) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, the employer had not secured the tiebacks of the suspension scaffold system to a structurally sound anchorage on the building.  The tiebacks were secured to a single steel cable that was wrapped around the parapet wall on the north side of the building. The parapet wall was not evaluated to determine if it would support the load of the suspension scaffold, personnel and materials loaded on the scaffold during work activities.

29 CFR  1926.451(g)(3)(iv): Vertical lifelines, independent support lines, and suspension ropes shall not be attached to each other, nor shall they be attached to or use the same point of anchorage, nor shall they be attached to the same point on the scaffold or personal fall arrest system.  (a) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, the employer had not verified that each vertical lifeline were independent of one another and/or attached at the same anchorage point, in-that the lifelines were secured to a single steel cable that wrapped around the parapet wall on the north side of the building.   (b) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, the employer had not verified the vertical lifelines were independent of the scaffold system in that the steel cable that held the lifelines and the steel cable that held the tiebacks were connected with a Crosby 3/4" D-ring shackle.

29 CFR  1926.451(d)(3)(vii): Tiebacks were not equivalent in strength to the suspension ropes:  (a) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, the tiebacks in the suspended scaffolding system were not equivalent in strength to the suspension ropes, in-that the 12 tiebacks were connected to a single steel cable. The steel cable was wrapped around the parapet wall on the north side of the building and was rated for 30,000 lbs.  The steel cable line is connected with a Crosby 3/4" D-ring shackle which derated the line to 14,000 lbs., exposing employees to a  scaffold collapse and fall hazard.

Additionally, the suspension scaffold was also tied back to the same steel cable the vertical life lines were connected to.    (b) On or about October 10, 2024, and at times prior, at 901 North 9th Street, Milwaukee, WI 53203, the employer had not verified the vertical lifelines were independent of the scaffold system in that the steel cable that held the lifelines and the steel cable that held the tiebacks were connected by a Crosby 3/4" D-ring shackle.
