29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a).  a.  On or about June 30, 2025, at the above-mentioned jobsite, the employer failed to ensure that employees wearing 3M full-face tight fitting respirators were medically evaluated prior to conducting demolition operations using handheld power chipping tools in the tunnel of the parking garage, thereby exposing employees to the hazards associated with respirator use.

On or about June 30, 2025, at the above-mentioned jobsite, the employer failed to ensure employees wearing 3M full-face respirators were fit tested when conducting demolition operations in the tunnel of the parking garage, thereby exposing employees to the hazards associated with silica exposure.

On or about June 30, 2025,  at the above-mentioned jobsite, the employer failed to ensure employees wearing 3M full-face tight-fitting respirators were clean shaven when conducting demolition operations in the tunnel of the parking garage, thereby exposing employees to the hazards associated with silica.

29 CFR  1926.1153(c)(1):  For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls,  specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a.  On or about June 30, 2025, the employer failed to implement the required engineering controls in accordance with Table 1 of the silica standard.  When conducting demolition operations in the tunnel of the parking garage, the employer did not equip chipping hammers with a water delivery system or commercially available dust collection system, thereby exposing employees to the hazards associated with silica.
