29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a - Back of Structure, Community Building, 900 Gary Smith Way, Forked River NJ:  The company worksite Foreman and a worker were exposed to fall hazards, in excess of 9 feet 8 inches, when walking and working  from a commerical structure's steep pitched roof without the use of fall protection. Condition noted  on or about 10/17/24.  b - Front of Structure, Community Building, 900 Gary Smith Way, Forked River NJ:  A worker was exposed to fall hazards, in excess of 14 feet 7 inches, when partially working from an unsecured, aluminum extension ladder (one foot on the ladder and the other on the commercial structure's steep pitched, upper roof) while not utilizing fall protection.  Condition noted  on or about 10/17/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a)(LOCATION)(IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)   a- Front of structure - Community Building - 900 Gary Smith Way, Forked River NJ:  A company worker was exposed to fall hazards, in excess of 14 feet 7 inches, when accessing to and egressing from a pitched roof using an aluminum whose side rails did not extend at least 3 feet above the upper landing surface. Observed on or about 10/17/24.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a- Front of structure - Community Building - 900 Gary Smith Way, Forked River NJ:  A company worker was exposed to fall hazards, in excess of 14 feet 7 inches, when utilizing a damaged aluminum extension ladder to access to and egress from a commercial structure's pitched roof as well as working from this damaged ladder.  Observed on or about 10/17/24.  b- Rear of structure -  Community Building - 900 Gary Smith Way, Forked River NJ: A company worker was exposed to fall hazards, in excess of 8 feet 8 inches, when applying weather wrap onto the exterior surface of a commercial structure from a damaged aluminum extension ladder.  Observed on or about 10/17/24.
