29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use: a) 40 Harbor Cove, Cape May, NJ - The employer allowed the employees to work from an elevated platform, pallet, attached to the forks of the Rough Terrain Forklift Truck, JCB Loadall 509-42, which was not designed by the manufacturer for such use. This exposed the employee to a fall hazard. This condition was observed on or about September 3, 2025. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. a) 40 Harbor Cove, Cape May, NJ - Rough Terrain Forklift Truck, JCB Loadall 509-42, was used to support scaffold platforms and the entire platform was not attached to the fork, thus exposing the employee to fall hazards. This condition was observed on or about September 3, 2025. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19
