29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 731-733 East Briarbrook Lane Park City, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling CertainTeed Landmark ClimateFlex AR polymer modified asphalt shingles and gasoline which can cause skin and eye irritation, drowsiness and/or dizziness, may cause pulmonary disease, is suspected of causing cancer and may be fatal if swallowed and enters airways.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 731-733 East Briarbrook Lane Park City, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets for CertainTeed Landmark ClimateFlex AR polymer modified asphalt shingles and gasoline at the job site. These chemicals can cause skin and eye irritation, drowsiness and/or dizziness, may cause pulmonary disease, is suspected of causing cancer and may be fatal if swallowed and enters airways.
