29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   a)  210 Coswell Avenue, Solvay, NY  13209, on the roof, on or or about 10/25/24:  Workers were installing roofing material onto a 10:12 pitch roof, with a ground to eave height of 26 feet, fall protection equipment was inconsistently used and where used, anchors were installed incorrectly, and connections to harnesses were incorrectly accomplished.  Abatement documentation must be submitted for this item.

29 CFR  1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:    a)  210 Coswell Avenue, Solvay, NY  13209, on or about 10/25/24, accessing the roof, or or about 10/25/24:  Workers were installing roofing material onto a 10:12 pitch roof, with a ground to eave height of 26 feet, workers used a ladder style material lift to access the roof.  This equipment is not designed for this purpose.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  210 Coswell Avenue, Solvay, NY  13209, on or about 10/25/24, on the roof, or or about 10/25/24:  Workers were installing roofing material onto a 10:12 pitch roof, with a ground to eave height of 26 feet, without using fall protection.  Melo Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 1534773, citation number 1, item number 1a and was affirmed as a final order on 1/28/22, with respect to a workplace located at 7854 Restmoor Drive, Baldwinsville, NY  13027.

29 CFR  1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, and not installed under the supervision of a qualified person.   a)  210 Coswell Avenue, Solvay, NY  13209, on or about 10/25/24, on the roof, or or about 10/25/24:  Workers were installing roofing material onto a 10:12 pitch roof, with a ground to eave height of 26 feet, where workers used a lifeline attached to a roof anchorage that was incorrectly installed, unable to maintain 5,000 lbs. of strength, and not installed under the supervision of a competent person.    Melo Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.502(d)(15), which was contained in OSHA inspection number 1534773, citation number 1, item number 1b and was affirmed as a final order on 1/28/22, with respect to a workplace located at 7854 Restmoor Drive, Baldwinsville, NY  13027.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  210 Coswell Avenue, Solvay, NY  13209, on or about 10/25/24, accessing the roof, or or about 10/25/24:  Workers were installing roofing material onto a 10:12 pitch roof, with a ground to eave height of 26 feet, and accessing that roof from the rear of the building with an extension ladder that did not extend at least 3 feet above the landing being accessed.    Melo Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1534773, citation number 1, item number 2a and was affirmed as a final order on 1/28/22, with respect to a workplace located at 7854 Restmoor Drive, Baldwinsville, NY  13027.
