29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) On or about 08/04/2025, on the site located at 127 Beechwood Avenue, Liverpool, NY 13088, the employer failed to ensure employees working on a 7:12 pitch roof were protected from falling through a hole on the north facing side of the main roof with fall hazards of approximately 11 feet ground to eave by personal fall arrest systems, covers, or guardrail systems erected around the holes.   b) On or about 08/04/2025, on the site located at 127 Beechwood Avenue, Liverpool, NY 13088, the employer failed to ensure employees working on a 7:12 pitch roof were protected from falling through a skylight on the south facing side of the main roof with fall hazards of approximately 9.5 feet ground to eave by personal fall arrest systems, covers, or guardrail systems erected around the skylight.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided.   a) On or about  08/04/2025, on the site located at 127 Beechwood Avenue, Liverpool, NY 13088, employees were not provided stairways or ladders to access the second story of the residential home and instead were utilizing the materials hoist as a ladder.

29 CFR  1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  a) On or about  08/04/2025, on the site located at 127 Beechwood Avenue, Liverpool, NY 13088, the employer did not ensure the Werner extension ladder was inspected for damage prior to use. The Werner extension ladder had one rung completely sawed in half and several rungs that had damage such as a partially cut through rung, gouges where the rungs weren't cut through completely, and one rung that was deformed and not perpendicular to the side rails.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a) On or about 08/04/2025, on the site located at 127 Beechwood Avenue, Liverpool, NY 13088, employees used a Werner extension ladder that had one rung completely sawed in half and several rungs that had damage such as a partially cut through rung, gouges where the rungs weren't cut through completely, and one rung that was deformed and not perpendicular to the side rails, to access the roof of a 2006 Ford E-350 work vehicle (VIN 1FTSS34L96HB21287).

Melo Roofing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1602993, citation number 1, item number 1 and was affirmed as a final order on 11/18/2024, with respect to a workplace located at 3463 Van Wie Drive East, Baldwinsville, NY 13027.  Melo Roofing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1623495, citation number 1, item number 1 and was affirmed as a final order on 11/18/2024, with respect to a workplace located at 321 Primrose Avenue, Syracuse, NY 13205.
