29 CFR  1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee had not retained the requisite understanding or skill, the employer did not retrain the affected employee.  a) Melo Roofing, Inc., 8135 Rizzo Drive, Clay, NY - On the roof. On or about August 4, 2025, the employer did not ensure compliance with the requirements of the standard, as workers were performing roofing operations while exposed to fall hazards of 8 feet from the eave to the ground on a 6:12 pitch roof. When these inadequacies were noted the employer did not retrain the affected employees.

29 CFR  1926.1053(b)(9): The employer did not ensure that the area around the top and bottom of ladders were kept clear.  a) Melo Roofing, Inc., 8135 Rizzo Drive, Clay, NY - At the site, on or about August 4, 2025, employees working on a roof used portable ladders to access the roof. The area around the bottom of the ladders were not kept clear as required, exposing the workers to fall hazards.

29 CFR 1926.1053(b)(22): The employer permitted employees to use ladders while carrying objects or loads that could cause the employee to lose balance and fall.  a) Melo Roofing, Inc., 8135 Rizzo Drive, Clay, NY - At the site, on or about August 4, 2025, the   employer permitted workers to carry materials such as bundles of shingles while using the ladder to access the roof. This exposed workers to fall hazards should the employee lose balance while being unable to maintain three points of contact during ladder use.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Melo Roofing, Inc., 8135 Rizzo Drive, Clay, NY - On the roof. On or about August 4, 2025, employees were engaged in residential roofing activities including but not limited to nailing material onto a 6:12 pitch roof, approximately 8 feet height eave to ground, without fall protection. The employer failed to ensure employees were protected from fall hazards by use of guardrail systems, safety net systems, or personal fall arrest systems.   Melo Roofing, Inc.,  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1666776, citation number 1, item number 1 and was affirmed as a final order on November 18, 2024, with respect to a workplace located at 127 Margo Lane, Fayetteville, NY.
