29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: (a) Acid Unload Station, 600 North Broad Street Phillipsburg, NJ 08865 Protective equipment for the body and extremities of sufficient coverage and chemical resistance was not provided and required for employee(s) transferring nitric acid (HNO3) from drum(s) to raw material tank(s). On or about August 1, 2024, employee(s) wearing Tyvek coats were splashed by nitric acid when to the transfer hose uncoupled during the transfer process, causing chemical burns to the body, arms & legs.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (a) Acid Unload Station, 600 North Broad Street Phillipsburg, NJ 08865 On or about August 1, 2024, employees were performing a non-routine task of transferring Nitric Acid (HNO3) from a customer return drum into the raw material tank. The employee(s) were not provided with training on procedures and suitable equipment for safe acid transfer, including sufficiently protective personal protective equipment. Employee(s) were exposed to the hazard of skin contact with splashed / sprayed nitric acid during the transfer process.
