29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A continuing, effective hearing conservation program (including the elements of noise monitoring, employee notification, audiometric testing, hearing protection, training, information, and recordkeeping) was not administered for instances such as, but not limited to: a) On November 25, 2024, an employee conducting pallet repairs was exposed to noise at 85.2% of the permissible daily dose, or an average sound level of 93.1 dBA, as measured over 263 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.8 dBA accounting for the period of 217 minutes unmonitored. b) On November 25, 2024, an employee conducting pallet repairs was exposed to noise at 73.3% of the permissible daily dose, or an average sound level of 91.8 dBA, as measured over 271 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.8 dBA accounting for the period of 209 minutes unmonitored. c) On November 25, 2024, an employee operating the saw was exposed to noise at 73.0% of the permissible daily dose, or an average sound level of 91.9 dBA, as measured over 266 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.7 dBA accounting for the period of 214 minutes unmonitored. d) On November 25, 2024, an employee operating the dismantler was exposed to noise at 84.5% of the permissible daily dose, or an average sound level of 93.3 dBA, as measured over 255 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.8 dBA accounting for the period of 225 minutes unmonitored.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done: a) On or about November 25, 2024, the employer failed to certify that a workplace hazard assessment had been performed.
