29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) On or about November 7, 2024, two employees transferring clay tiles from a residential roof to the ground, while employees worked above, were exposed to a struck by hazard from falling clay tiles; the employer did not ensure the two employees working under employees removing clay tiles were protected from a head injury from impact, or falling clay tiles by way of a protective helmet.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about November 7, 2024, three employees removing clay tiles from a residential roof did not recognize the fall hazards while exposed to a fall of thirteen-feet; the employer did not ensure to provide a training program for each employee who might be exposed to fall hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) On or about November 7, 2024, three employees removing clay tiles from a residential roof were exposed to a fall of thirteen-feet; the employer did not ensure that each employee engaged in the removal of the clay tiles were protected from the thirteen-foot fall by a guardrail system, safety net system, or personal fall arrest system.  The All Sides Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1620587, citation number 1, item number 1 and was affirmed as a final order on October, 24, 2022, with respect to a workplace located at 8602 Bauerdale Ave, Parma, Ohio 44129.  The All Sides Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1489122, citation number 1 item number 1 and was affirmed as a final order on October 1, 2020, with respect to a workplace located at 154 Depot St, Berea, Ohio 44107.  The All Sides Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1486038, citation number 2, item number 1 and was affirmed as a final order on October 1. 2020, with respect to a workplace located at 2038 Bunts Road, Lakewood, Ohio 44107.
