29 CFR 1910.132(d)(1)(i): The employer did not select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; On or about November 14, 2024, an employee working on the Sinto Pouring Deck was using a ladle to dump molten aluminum at 1320 degrees Fahrenheit into a mold. As the employee attempted to remove the ladle from the furnace, they dropped the ladle, causing the molten metal to splash in their boots, resulting in 3rd degree burns and a skin graph to their right foot. The employer did not ensure that the employee was wearing splash resistant PPE to prevent accidental contact with the molten metal. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about November 14, 2024, an employee pouring molten aluminum received burns to their foot and was hospitalized for two weeks. The employer failed to report the in-patient hospitalization within 24 hours. The employer reporting the incident on December 2, 2024.
