29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   a. Lot 22 - On or about January 3, 2025, employees engaged in framing work to include using ladders, working from height, and operating saws and nail guns, were doing so without the employer performing routine inspections of the jobsite to evaluate and implement safety measures to ensure the employees had and were using the appropriate methods and safeguards to not be exposed to fall and struck by hazards.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Lot 22 - On or about January 3, 2025, employees engaged in sheathing work were using pneumatic nail guns without eye protection, employees were exposed to a struck by hazard. 29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a. Lot 22 - On or about January 3, 2025, employees were engaged in sheathing work at the peak of a multilevel single-family home without fall protection. The employees were exposed to a fall hazard working on the roof with an 8:12 pitch and an estimated fall from the peak of 30 feet.  b. Lot 22 - On or about January 3, 2025, employees engaged in sheathing work were exposed to fall to the interior from unsheathed areas of the roof and from holes cut into the roof that would result in a fall to the next lower level.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
