29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   a. Lot 45 - On or about January 10, 2025, employees engaged in framing work to include using ladders, working from height, and operating saws and nail guns, were doing so without the employer performing routine inspections of the jobsite to evaluate and implement safety measures to ensure the employees had and were using the appropriate methods and safeguards to not be exposed to fall and struck by hazards.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. Lot 45 interior of the house - On or about January 10, 2025, employees were using a 14-foot Werner aluminum ladder to gain access to the 2nd floor, the ladder was not positioned to be at least 3 feet above the landing. Employees were exposed to a fall hazard greater than 10 feet to the lower level.  b. Lot 45 interior of the house - On or about January 10, 2025, employees were using a 14-foot Werner aluminum ladder to gain access to the 2nd floor, the ladder was not secured at the top to prevent the ladder from slipping or becoming dislodged, exposing employees to a fall hazard.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a. Lot 45 - On or about January 10, 2025, employees engaged in framing work on the 2nd floor of the single-family house were exposed to a fall hazard to the first floor of approximately 10 feet. Lot 45 - On or about January 10, 2025, employees were engaged in framing work, which included framing on the 2nd floor and installing trusses while working from the top plate, the employees were exposed to fall hazards of greater than 20 feet without training on fall recognition and mitigation methods.
