29 CFR 1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Lot #5, Roof: On 01/09/2025, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided while operating these tools at 120 PSI.

29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:  a) Lot #5: On 01/09/2025, the employer exposed employees to amputation/severe laceration hazards, in that the air compressor is missing a cover over the starter recoil, exposing operators to moving parts when starting and stopping the equipment.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Lower roof, On or about 01/09/2025, the employer exposed employees to fall hazards of 10-feet, 4-inches to 13-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in roof sheathing installation activities on a low pitched roof.   Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1739480, citation number 1, item number 1 and was affirmed as a final order on 10/17/2024, with respect to a workplace located at Nickle Creek, Coweta, GA 30265.  Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1713610, citation number 1, item number 1 and was affirmed as a final order on 05/14/2024, with respect to a workplace located at Lot #158-162 Upscomb Circle, Cartersville, GA 30120.
