29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:  a) On or about April 19, 2025, employees performing framing activities were exposed to struck-by hazards when a rough terrain forklift was operated by an employee who had not received the required training or certification to safely operate the equipment.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  a) (Lots 150-154) 9 Vernon Lane, Roof: On or about April 19, 2025, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing activities while operating these tools at 200 PSI.  b) (Lots 166-170) 26 Vernon Lane, Roof: On or about April 19, 2025, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing activities while operating these tools at 200 PSI.  Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1797119, citation number 1, item number 1 and was affirmed as a final order on 03/05/2025, with respect to a workplace located at Lot #5 Hensley Park Lane, Dawsonville, GA 30534.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) (Lots 150-154) 9 Vernon Lane, Roof: On or about April 19, 2025, the employer exposed employees to fall hazards of approximately 21 feet, 3 inches to the lower level, in that a fall protection system was not provided to employees engaged in framing and sheathing activities.  b) (Lots 166-170) 26 Vernon Lane, Roof: On or about April 19, 2025, the employer exposed employees to fall hazards of approximately 20 feet, 11 inches to the lower level,  in that a fall protection system was not provided to employees engaged in framing and sheathing activities.  Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1797119, citation number 2, item number 1, and was affirmed as a final order on 03/05/2025, with respect to a workplace located at Lot #5 Hensley Park Lane, Dawsonville, GA 30534.  Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1739480, citation number 1, item number 1 and was affirmed as a final order on 10/17/2024, with respect to a workplace located at Nickle Creek, Coweta, GA 30265.  Rooster Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1713610, citation number 1, item number 1 and was affirmed as a final order on 05/14/2024, with respect to a workplace located at Lot #158-162 Upscomb Circle, Cartersville, GA 30120.
