29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about January 16, 2025, employees were exposed to cave-ins and other hazards associated with working in and around the excavation that had not been inspected by a competent person. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d). UNO Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 1649727, citation number 1, item number 2 and was affirmed as a final order on May 26, 2023, with respect to a workplace located at 2 N. Williams., Westmont, IL. 60559.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about January 16, 2025, employees were not protected by a cave in protective system while working in a trench approximately 7-7.5 feet deep, exposing employees to struck-by hazards associated with a cave-in. No abatement certification or documentation is required for this item. UNO Construction CO., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1649727, citation number 1, item number 3 and was affirmed as a final order on May 26, 2023, with respect to a workplace located at 2 N. Williams., Westmont, IL. 60559.
