OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards:  a)  Shed Production Building:  On or before January 27, 2025, and at times prior, employees were exposed to crushing hazards while operating and working near jib cranes with underhung hoists.

29 CFR 1910.213(c)(2): Hand-fed circular ripsaw(s) were not furnished with a spreader to prevent material from squeezing the saw or being thrown back on the operator:  a)   Shed Production Building:  On or about January 27, 2025, employees required to use the Grizzly 10" table saw were exposed to kick-back and amputation hazards during rip cutting as this saw was operated without a spreader device.  This condition exposed employees to struck-by and amputation hazards.

29 CFR 1910.213(c)(3): Hand-fed ripsaw(s) did not have non kickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator:   a)   Shed Production Building:  On or about January 27, 2025, employees required to use the Grizzly 10" table saw were exposed to kickbacks and amputation hazards during rip cutting as this saw was operated without non-kickback fingers.  This condition exposed employees to stuck-by and amputation hazards.

29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:  a)   Shed Production Building:  On or about January 27, 2025, employees were required to use compressed air for wood chip cleaning purposes.  The compressed air line pressure was set at approximately 102 p.s.i.  This condition exposed employees to struck-by hazards which may result in an air embolism.

29 CFR 1904.41(a)(1)(i): The employer failed to submit the establishment's OSHA 300A record electronically when required to do so (an establishment having 20-249 employees at any time during the previous calendar year and establishment being classified in an industry listed in Appendix A to Subpart E of Part 1904):  a)  On or before April 22, 2025, and at times prior, the employer failed to electronically submit their OSHA Form 300A data for calendar year 2024 to OSHA's Injury Tracking Application (ITA) system by March 2, 2025, when required to do so.  The employer was classified in covered North American Industry Classification System (NAICS) 321992, and had a peak employment of approximately 81 employees at the Delta, Colorado facility in 2024.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)   Shed Production Building:  On or about January 27, 2025, employees were required to wear tight-fitting, half-face respirators during water-based paint spraying operations.  The employer did not implement all required elements of a Respiratory Protection Program that would include, but is not limited to: (1) medical evaluations for employees required to wear tight-fitting, half-face respirators, (2) fit testing for employees required to wear tight-fitting, half-face respirators, (3) training for employees regarding the hazards they may encounter during the required use of tight-fitting, half-face respirators, (4) training for employees regarding the limitations of tight-fitting, half-face respirators they are required to use, and (5) procedures for evaluating the effectiveness of the Respiratory Protection Program.  This exposed employees to potential pulmonary and cardiovascular hazards due to the use of respirators.
