29 CFR 1926.1153(g)(4): The employer did not designate a competent person to make frequent and regular inspections of job sites, materials, and equipment to implement the written exposure control plan: At a worksite located at 2300 Main Street, Kansas City, MO 64108: Employees were exposed to respiratory health hazards in the form of crystalline silica. This was demonstrated on or about March 11, 2025, when employees were dry-cutting concrete bridge supports. The employer did not designate a competent person to make frequent and regular inspections of job sites, materials, and equipment to implement the written exposure control plan. The employers control plan stated that Wet methods or dust/vacuum collection systems with high-efficiency particulate air (HEPA) filters would be used. Employees were exposed to respiratory hazards from the accumulation of silica dust when there was a lack of vacuums systems and/or wet methods were not utilized during the course of the project when different tasks were being performed.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: At a worksite located at 2300 Main Street, Kansas City, MO 64108: Employees were exposed to health hazards in the form of crystalline silica. This was demonstrated on or about March 11, 2025, when employees were exposed to respiratory hazards while dry cutting concrete and the employer did not maintain and/or could not produce either air monitoring data or objective data sufficient to accurately characterize employee exposures to respirable crystalline silica.
