29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the jobsite located at 1705 South Webb Rd. Wichita, Kansas, employee(s) engaged in commercial masonry activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the jobsite. Employee(s) were handling Acme thinBRIK red bricks and Acme Premix gray type N mortar/mix. The chemical hazards associated with these products include: skin and eye irritation/burns, redness and/or swelling of the conjunctiva, nausea and/or vomiting, respiratory tract irritation, may cause an allergic skin reaction and may cause cancer.

Wichita, Kansas, employee(s) engaged in commercial masonry activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheet (SDS) for Acme thinBRIK red bricks and Acme Premix gray type N mortar/mix at the job site. The chemical hazards associated with these products include: skin and eye irritation/burns, redness and/or swelling of the conjunctiva, nausea and/or vomiting, respiratory tract irritation, may cause an allergic skin reaction and may cause cancer.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  At the jobsite located at 1705 South Webb Rd. Wichita, Kansas, employee(s) engaged in commercial masonry activities, dry cutting on Acme thinBRIK red bricks, were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.
