29 CFR  1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates, mud sills or other adequate firm foundations:  At the jobsite located at 9701 W. 53rd St. N., Maize, KS 67101, employees engaged in masonry activities were exposed to fall hazards of 13 feet 1 inch in that the tubular welded frame scaffold system's legs were in direct contact with the ground. The baseplate was missing and not resting on the mudsill, while employees worked from the platforms located approximately 13 feet above ground. Additionally, one of the other baseplates was observed not stable. The baseplate had been partially placed on a wooden mudsill.

Employees were gaining access and egress to the work platforms by climbing up and down the scaffolding frames and cross braces in lieu of using a ladder.

29 CFR  1926.451(h)(2)(ii): A toe-board was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  At the jobsite located at 9701 W. 53rd St. N., Maize, KS 67101, employee working and walking under to get materials, and other contractors personnel walking by the tubular welded frame scaffold were exposed to struck-by hazards in that the toe-boards were not erected along the edge of the working platforms to prevent items from falling, such as but not limited to the various stones, mortar hammer, bucket, mortar mix, shovels, gasoline can, a hard hat, and a Stihl quickie saw. There was no barricade to keep people out to avoid falling objects.
