29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Residential construction located at 536 Traminer Way, Braselton, GA 30548, Second level top plate: On or about 03/24/2025, the employer exposed employees to fall hazards of 19-feet to the lower ground level, in that a fall protection system was not provided while installing roof trusses and engaged in other framing activities.   B & O Martinez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1718628, citation number 1, item number 2 and was affirmed as a final order on 02/21/2024, with respect to a workplace located at 903 Bloomcrest Dr. Lot 57 Lawrenceville, GA 30045.  B & O Martinez Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1733135, citation number 2, item number 1 and was affirmed as a final order on 05/20/2024, with respect to a workplace located at 598 Crystal Lake Parkway, Hoschton, GA 30548.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used:  a) Residential construction located at 536 Traminer Way, Braselton, GA 30548, Second level top plate: On or about 03/24/2025, the employer exposed employees to fall hazards while working at top plate heights above 19 feet from the lower ground level, in that employees had not been trained to assemble and inspect the fall protection system as two ropes were tied into an anchor that was intended to only support one worker.
