OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards.   a. Fry Foods, Inc. - Tiffin, Ohio: On or about March 26, 2025, employees who accessed the pallet storage rack system, located in the #2 storage freezer (west), were exposed to struck-by and crushing injuries in that storage racks were not marked with its rated capacity, columns were not anchored to the floor, were missing horizontal and diagonal bracing, and racks presented with multiple areas of damage to column posts, horizontal bracing, diagonal bracing, and base plates.    b. Fry Foods, Inc. - Tiffin, Ohio: On or about March 26, 2025, employees who worked in #1 storage freezer (east), were exposed to struck-by and crushing injuries in that the building's supporting I-beams were damaged and removed from their floor anchors.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.132(d)(2):The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  Fry Foods, Inc. - Tiffin, Ohio: On or about March 26, 2025, the required workplace hazard assessment did not include a documented hazard assessment with written certification that identified the person certifying the workplace evaluation and date of the hazard assessment.  Employees who work in the freezer storage areas were exposed to cold stress injury/illnesses such as, but not limited to, frostbite, hypothermia, and chilblain.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.178(n)(14): Running over loose objects on the roadway surface were not avoided.  Fry Foods, Inc. - Tiffin, Ohio: On or about March 5, 2025, the employer did not ensure that the floor surface where forklifts are operated in Freezer #1 was free of loose objects.  A loose piece of sheet metal that was approximately 2' x 3' was used to cover a section of damaged and uneven floor. Forklift operators, and employees working to stack product in the area, were exposed to struck-by hazards in that running over loose objects can lead to loss of control and affect forklift and load stability.

A damaged and uneven section of flooring in Freezer #1, where forklifts operated and employees stacked boxes, resulted in unstable loads.
