OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees are constantly walk/working in-between non-anchored merchandise racks. On or about: April 1, 2025 Location: 302 Walnut Ave. Bronx, NY 10454 a) Merchandise racks were not anchored to the ground, which are approximately 20 feet in height. Workers are walking/working and utilizing manual pallet jacks and forklift between multiple racks daily. Workers exposed to struck by and/or crushing hazard. b) Merchandise racks failed to display in one or more conspicuous locations a plaque to permanently and prominently display the permissible loading of the rack. Workers exposed to struck by and/or crushing hazard.
