OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees from exposure to fall hazards.     a) On or about April 1, 2025, at the above addressed jobsite, employees were elevated approximately fifteen (15) feet above ground level on the forks of a Gradall 534D-9 Rough Terrain Forklift Truck in order to conduct framing activities on the gable end. The employee was not provided with fall protection and was not otherwise elevated in a manner consistent with the requirements of ANSI B56.6 Section 5.15.1.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)On or about April 1, 2025, at the above addressed jobsite, an employee performing residential carpentry operations, sixteen (16') feet above the ground, was not protected from falls, thereby exposing employees to fall hazards.  b)On or about April 1, 2025, at the above addressed jobsite, employees performing residential carpentry operations, twelve (12') feet four (4") inches above the ground, were not protected from falls, thereby exposing employees to fall hazards.  McNally Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1686889, citation number 1, item number 1 and was affirmed as a final order on October 6, 2023, with respect to a workplace located at 1501 Waldorf Circle in Wheaton, Illinois 60189.
