OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards. On or about April 01, 2025, at the intersection of E. Reno and S. Harrah Rd., employees were exposed to crushed-by hazards when they entered the excavator bucket to be lifted out of and lowered into the excavation by the excavator.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. On or about April 01, 2025, at the intersection of E. Reno and S. Harrah Rd , employees were installing water lines in an excavation more than four (4) feet in depth without a safe means of egress. W.E.B. Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.651(c)(2), which was contained in OSHA inspection numbers 1483288, citation number 1, item number 1a, and was affirmed as a final order on September 14, 2020, with a final abatement date of August 18, 2020, with respect to a workplace hazard located on the corner of Britton Road and Sooner in Oklahoma City, OK.
