The employee was using a closed A- frame ladder, propped against the side of the building on the second story, exposing the employee to fall hazards.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite located at 110 Park Ave., Swarthmore, PA 19081 on or about April 15, 2025- The employer did not ensure that employees framing on the second level of a residential building, approximately 15 feet above the ground level, were protected from fall hazards by the use of a fall protection system. Hawk Builders LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1579905, citation number 1, item number 2 and was affirmed as a final order on 8/31/2022, with respect to a workplace located at 8 Kings Bridge Rd. Fairfield, NJ 07004.
