29 CFR 1926.502(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) Job site, 300 North Dithridge Avenue, Pittsburgh, PA: On or about April 15, 2025 during construction activities, the employer did not ensure the existing rails and/or walls along the edge of the outside patio were of adequate height to serve as fall protection in that the rails and/or walls were determined to be between approximately 22 to 28 1/2 inches tall, exposing an employee of a fall hazard of up to approximately 10 feet.

29 CFR 1926.20(b)(2): A program that provided for frequent and regular inspections of the job sites, materials, and equipment to be made by a competent person was not in use: a) Job site, 300 North Dithridge Avenue, Pittsburgh, PA: On or about April 15, 2025 during construction activities, the employer did not ensure a system of hazard recognition and abatement was implemented at the job site. Deficiencies noted during the inspection included, but were not limited to, failing to ensure fall protection was of adequate height where fall hazards of over 6 feet existed, not preventing electrical extension and related cords from existing as tripping hazards in the office area and not ensuring temporary wiring in the office area was protected from accidental contact.
