29 CFR  1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees working on the elevated portions of the winder platform, greater than four feet above a lower level,  were protected from fall hazards by one or more of the systems described in 29 CFR 1910.28(b)(1)(i). This condition exposed employees to fall hazards.

29 CFR  1910.107(c)(6): Electrical wiring, motors, and other equipment outside of but within twenty (20) feet of any spray area, and not separated therefrom by partitions, produced sparks under normal operating conditions and did not otherwise conform to the provisions of subpart S of this part for Class I, Division 2 Hazardous Locations:  (a)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure the Duplex outlet boxes along the Northwest wall of the Winder spray area conformed to provisions of subpart S of this part for Class, Division 2 Hazardous Locations.  This condition exposed employees to fire and explosion hazards.  (b)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure an outlet box on the Medium Spincast Tank  within the Medium Spincast Tank spray area conformed to provisions of subpart S of this part for Class, Division 2 Hazardous Locations.  This condition exposed employees to fire and explosion hazards.  (c)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure electrical equipment within the Robot Head Chopping  spray area conformed to provisions of subpart S of this part for Class, Division 2 Hazardous Locations. This condition exposed employees to fire and explosion hazards.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating the Medium Spincast Tank were protected from ingoing nip points created by outward movement of the linear boom over rollers. This condition exposed employees to ingoing nip points.   (b)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating the Medium Spincast Tank were protected from caught-in hazards created by exterior mold clamps during rotation of the medium molds. Employees performed work in proximity to the protruding clamps that create caught-in hazards during rotation. This condition exposed employees to caught-in hazards.   (c)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating the Robot Head Chopping (Yaskawa Motoman MH 50-20) were protected from struck-by hazards in that appropriate machine guarding had not been implemented to prevent employee access to cells during autonomous operations. This condition exposed employee to struck-by hazards.

This condition exposed employees to ingoing nip point hazards.  (b)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating the northwest winder was protected from ingoing pinch points created by rotation of the chain and sprocket on the winder base where appropriate machine guarding had not been implemented. This condition exposed employees to ingoing nip points.    (c)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating blue tank carts were protected from ingoing nip points created by rotation of the chain and sprocket of the blue tank carts in the finishing department. Multiple tank carts were identified with missing or damaged guarding. This condition exposed employees to ingoing nip points.  (d)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about, and at times prior to April 29, 2025, the employer did not ensure employees operating the northwest winder were protected from ingoing pinch points created by rotation of the winder mold and tank rollers where appropriate machine guarding had not been implemented. This condition exposed employees to ingoing nip points.
