29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L (Scaffolds):  (a)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2025, the employer did not ensure that the elevated platform used for removing lifting straps from the fiberglass tanks were properly attached to the Komatsu 30 Forklift, Model #: FG30HT-16, in that, securement chains or other methods were not adequate to secure the basket to the mast.  This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift.  (b)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2025, the employer did not ensure that the elevated platform used for removing lifting straps from the fiberglass tanks were properly attached to the Mitsubishi Forklift, Model #: FG50CN1, in that, securement chains or other methods were not utilized to secure the basket to the mast.  This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift.  (c)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2025, the employer did not ensure employees were protected from serious injury while using of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the forklift manufacturer. Employees utilized the platform to remove lifting straps from fiberglass tanks and were not specifically approved by the forklift manufacturer nor did it meet ASME/ITSDF B56.6-2011 requirements. The platform did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to fall hazards and crushing hazards related to the platform separating from the mast.  (d)Design Tanks, LLC at 612 West Blackhawk Street, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2025, the employer did not ensure, that while employees were using a personnel platform connected to the Komatsu 30 Forklift, Model # FG30HT-16, that lifting straps and equipment had been allowed to accumulate on the floor of the platform. This exposed employees to caught-in, trip, and fall hazards.
