29 CFR 1910.178(l)(4)(i):Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. On or about February 12, 2025, at an establishment located at 3805 North Freedom Road, Appleton, WI , the employer did not ensure that a forklift operator involved in an accident had received refresher training, including an evaluation of that training, to ensure that they had the knowledge and skills to safely operate the lift.
