29 CFR  1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means.   On or about April 30, 2025, the employer did not ensure that supported scaffolds were restrained from tipping as required.  Employees were using a supported scaffold with a height to base width ratio of five to one (5:1) while conducting mason work.

29 CFR  1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about April 30, 2025, The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  Employees working at approximately 21.9 feet or more above a lower level were subject to fall hazards due to the setup of the supported scaffold.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about April 30, 2025, employees were exposed to fall hazards while performing mason work on unguarded balconies and roof area.  The employer did not certify that employees had been trained to recognize fall hazards, and the procedure to be followed in order to minimize those hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about April 30, 2025, employees engaged in residential construction activities 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system.  Employees working at approximately 20.5 feet or more above ground level were not protected from falling while conducting residential mason work.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.   Instance (a): On or about April 30, 2025, The employer did not ensure that supported scaffolds were free of potential fall hazards.  Employees operating at approximately 20.7 feet or more above a lower level were not protected from falling to that lower level by fall protection while conducting mason work.  Instance (b): On or about April 30, 2025, The employer did not ensure that scaffolds were free of potential fall hazards.  Employees working at approximately 20.5 feet or more above ground level were not protected from falling while walking on unguarded scaffold boards between a balcony, supported scaffold, and roof.  Moran Masonry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1687377, citation number 1, item number 2 and was affirmed as a final order on October 23, 2023, with respect to a workplace located at 111 E Crystal Lake Ave, Crystal Lake, IL 60012.
