29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  a) New residential construction located on Lots 37-50 Bella Fields Crossing, Suwanee, GA 30024, Top plate: On or about 05/01/2025, the employer exposed employees to struck by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees operating these tools at 130 PSI.  Pro-ATL Construction LLC was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA Inspection Number 1646369, citation number 1, item number 1 and was affirmed as a final order date on 07/12/2023, with respect to a workplace located at 4271 Woodward Mill Road, Millcroft Subdivision, Lot 75, Sugar Hill, GA 30518.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located on Lots 37-50 Bella Fields Crossing, Suwanee, GA 30024, Top Plate: On or about 05/01/2025, the employer exposed employees to fall hazards of approximately 35 feet, to the lower ground level, in that a fall protection system was not provided to an employee engaged in framing activities.  Pro-ATL Construction LLC was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1646369, citation number 1, item number 2 and was affirmed as a final order date on 07/12/2023, with respect to a workplace located at 4271 Woodward Mill Road, Millcroft Subdivision, Lot 75, Sugar Hill, GA 30518.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) New residential construction located on Lots 37-50 Bella Fields Crossing, Suwanee, GA 30024: On or about 05/01/2025, the employer failed to inspect all electrical extension cords used to provide power to electric tools, in that an red 50-ft. electrical cord was damaged and exposing the internal insulated energized wires. An inspection of these cords was not performed prior to the shift as these cords were not repaired or removed from service.
