1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a.) On or about May 2, 2025, the employer failed to ensure that the safety net system installed under the bridge for a resurfacing project was drop-tested at the jobsite following its initial installation. As a result, employees working above the net were exposed to fall hazards of approximately 20 feet into a creek located directly below the work area.

29 CFR 1926.502(c)(5): Defective nets shall not be used. Safety nets shall be inspected at least once a week for wear, damage, and other deterioration. Defective components shall be removed from service. Safety nets shall also be inspected after any occurrence which could affect the integrity of the safety net system. a) On or about May 2, 2025, the employer failed to ensure that defective components of the chain-link safety-net fall-protection system installed beneath the bridge were removed from service after inspection. Despite visibly deficient conditions, lever-ratchet hoists without safety-latch gates, heavily rusted alloy chains lacking rated-load identification, distorted welded shackles on the outriggers, and eye terminations of the main support cables kinked by missing thimbles, the net remained in use, thereby exposing employees working roughly 20 feet above a creek to fall hazards and the additional risk of drowning.
