29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about May 28, 2025, it was documented that employees performing cleaning and sanitation in the Harvest section of Gibbon Packing, LLC. located at 218 East Highway 30, Gibbon, Nebraska were exposed to fall hazards in that the employer did not ensure areas where employees were required to clean as part of their nightly duties was protected against fall hazards. Instances include but are not limited to cleaning performed near and/or around the catwalk between the Bull Header and the Down Puller where the catwalk walking working surface measured approximately 4 feet, 10 inches from the pit top to the just above the blood pooled within the pit. Specifically, approximately 11 inches horizontally was unguarded between the wall and the catwalk guardrail on the Bull Header side, approximately 12 inches horizontally was unguarded before start of catwalk guardrail closest to the Bull Header on the Down Puller side, and a single chain was attached across the integrated catwalk ladder.
