29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: At a workplace located at 590 Woodrow Street, Denmark, Wisconsin; the employer did not ensure that each affected employee used appropriate eye protection when exposed to eye hazards from flying particles and caustic liquids when: On or about August 3, 2025: a) Sanitation employees washing down sanitation chemicals in QX5 were not wearing chemical goggles exposing the employees to potential eye injuries from caustic liquids. On or about August 29, 2025: b) Sanitation employees walking through QX3 while sanitation work was being conducted, were not wearing safety glasses or any form of eye protection while water was sprayed during "pre op", exposing the employees to flying particulate. The same employees were not wearing chemical goggles as sanitation chemicals were applied and washed down, exposing the employees to potential eye injuries from caustic liquids. c) Sanitation employees washing down sanitation chemicals in QX3 were not wearing chemical goggles exposing the employees to potential eye injuries from caustic liquids. On September 5, 2025: d) Sanitation employees washing down sanitation chemicals in QX5 were not wearing chemicals goggles exposing the employee to potential eye injuries from caustic liquids.

29 CFR 1910.1200(e)(1)(i): Employers shall develop, implement, and maintain at each workplace a written hazard communication program including a list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas): On or about August 29, 2025, at a workplace located at 590 Woodrow Street, Denmark, Wisconsin; the employer's hazard communication program did not include a list of hazardous chemicals known to be present in the employer's work areas. Hazardous chemicals such as, but not limited to Quorum Green, Quorum Brown, Questar CAF, Whisper V, and CD-631 were present in the employees' work areas or were used by employees to conduct sanitation work.

The Support Help employee was not informed of the location and availability of the written hazard communication program, the list of hazards chemicals, nor the safety data sheets required by this section.
