29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. LOCATION: The worksite at 1980 Commonwealth Avenue in Brighton, MA On or about July 3rd the employer allowed workers to utilize a suspended scaffold system that was not constructed in accordance with the design by a qualified person. The following flaws and deviations from the standards as written were observed to be in place: a) Scaffolding supporting the outrigger beams, and the beams themselves, did not rest on surfaces capable of supporting at least 4 times the load imposed on them by the scaffold operating. b) Suspension scaffold outrigger beams were not restrained to prevent movement. c) Before the scaffold was used, direct connections were not evaluated by a competent person to confirm that the supporting surfaces were capable of supporting the loads to be imposed. d) Suspension scaffold connections were not designed by an engineer experienced in such scaffold design. e) Tiebacks were not secured to a structurally sound anchorage on the building or structure. f) Outrigger beams which are not stabilized by bolts or other direct connections to the floor or roof deck were not secured by tiebacks. g) Scaffold ladder rungs were loaded in excess of their maximum intended loads or rated capacities. h)Scaffolds were not erected or altered by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection.

LOCATION: The worksite at 1980 Commonwealth Avenue in Brighton, MA On or about July 3rd the employer exposed workers to fall hazards when vertical lifelines were tied around a brick chimney stack by knots and without softeners or protection for the line where it might bite into the brick corners.

The employer, Complete Restoration & Waterproofing Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1482534, citation number 1, item number 1 and was affirmed as a final order on 12/23/2020, with respect to a workplace located at 210 Harrison Ave. Boston, MA 02111.
