OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn and explosion hazards.   a. On or about July 24, 2025, the employer did not ensure that employees were protected from the recognized hazard of molten metal encapsulating water that resulted in a steam explosion which exposed employees to struck-by and thermal burn hazards.  On July 24, 2025, an employee was transporting molten metal in a drain tub in an area where rainwater had accumulated on the floor by means of a Toyota Forklift Truck - model number 8FGU32. The molten metal contacted the water resulting in the steam explosion event.

29 CFR  1910.22(d)(1):  (1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition;  a.  On or about July 24, 2025 and days prior, the employer failed to ensure that the working surface at the drain trough area was inspected regularly and maintained in a safe condition.  Employees were tasked to handle the molten-filled drain tub in the drain trough area where the working surface was uneven, which included potholes and standing water at drain tub location.  The condition exposed employees to slip and/or struck by hazards as a result.

29 CFR  1910.132(d)(1):  The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  a. On or about July 24, 2025 and days prior, the employer failed to ensure that an adequate assessment of the hazards associated with handling the molten iron drain tub was performed to identify the potential exposure to molten iron splashing/spilling from the tub and/or molten iron contacting water when employees performed the repositioning task. Employees were exposed to serious burn hazards due to the lack of flame-resistant (FR) protective equipment.

29 CFR  1910.178(o)(1):  Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered.  a. On or about July 24, 2025, employees were repositioning a molten iron drain tub from the Drain Trough area with the forks of a Toyota Forklift, Model 8FGU32, Serial 70918, placed close together in the center of the tub. The employer did not ensure that the tub was stable and safely handled with the forklift by ensuring the tub was secured to the forklift and/or the forks were spread out to ensure the load was balanced and stable on the forks. The condition exposed employees to struck-by hazards as a result.

29 CFR  1910.132(a):  Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a.  On or about July 24, 2025 and days prior, the employer failed to ensure that employees were provided with protective equipment, such as, but not limited to, flame-resistant (FR) garments when handling the molten iron drain tub to protect from the potential exposure to molten iron splashing/spilling from the tub and/or molten iron contacting water when employees performed the repositioning task. The condition were exposed to serious burn hazards as a result.  OSCO Industries Inc., was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1910.132(a) which was contained in OSHA inspection number 1690660, citation number 1, item number 1 and was affirmed as a final order on February 01, 2024, with respect to a workplace located at 202 Vine Street, New Boston, Ohio 45662.
