29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Christian Martinez DBA Christian Martinez failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected.  Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of October 7, 2025.  Citation 1, Item 2 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of October 7, 2025.  Citation 2, Item 1 a Repeat - Serious violation of 29 CFR 1926.501(b)(13) with an abatement date of October 7, 2025.  Citation 2, Item 2 a Repeat - Serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of October 7, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about August 14, 2025, at W176 N7260 Raw Amber Ct, Menomonee Falls, WI 53051, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.

(a) On or about August 14, 2025, at W176 N7260 Raw Amber Ct, Menomonee Falls, WI 53051, the employer did not ensure that all employees that were installing a roof were trained to recognize fall hazards and how to implement fall protection methods, exposing employees to fall hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about August 14, 2025, at W176 N7260 Raw Amber Ct, Menomonee Falls, WI 53051, employees installing a roof on a residential home roof with a 9:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 26 feet 2 inches from the roof eve to the ground below on the back (North) side of the home.  Christian Martinez DBA Christian Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1811089, citation number 1, item number 2 and was affirmed as a final order on April 30, 2025, with respect to a workplace located at 600 E. Quail Run, Oak Creek, WI 53154.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about August 14, 2025, at W176 N7260 Raw Amber Ct, Menomonee Falls, WI 53051, employees were accessing the roof to conduct roofing work from a ladder at the south side of the home which did not extend at least three (3) feet above the upper landing surface, exposing employees to a fall hazard of approximately 15 feet 11 inches.  Christian Martinez DBA Christian Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1811089, citation number 1, item number 3 and was affirmed as a final order on April 30, 2025, with respect to a workplace located at 600 E. Quail Run, Oak Creek, WI 53154.
