1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: On or about August 19, 2026, an employee engaged in hazardous chemical mitigation activity at the Cooperative Producers, Inc. facility located at or near 9870 S. Railway St. - Holstein, Nebraska , was exposed to atmospheric hazards in that the employer failed to ensure that the employee had received the level of training required by the standard prior to attempting to stop and/or repair an ammonia leak.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about August 19, 2026, an employee engaged in hazardous chemical mitigation activity at the Cooperative Producers, Inc. facility located at or near 9870 S. Railway St. - Holstein, Nebraska, 68950, was exposed to atmospheric hazards in that the employer failed to ensure that the employee monitored the anhydrous ammonia levels in the incident area prior to attempting to stop and/or repair an ammonia leak.
