29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Utica Metal Products, Inc., 1526 Lincoln Avenue, Utica, NY 13502, on or about 12/10/2025; A Hand Buffing Operator was exposed to a continuous noise level at a 85.6% dose of the OSHA permissible exposure limit (PEL). The equivalent dBA is approximately 86.88 dBA calculated as the 8-hour time weighted sound pressure level for a sampling period of 435 minutes. A zero increment was used for the 45 minutes not sampled. Employee was wearing Laser Lite Earplug LL30G/6XF60 (NRR 32) hearing protection . The employer did not administer a continuing, effective hearing conservation program.  b) Utica Metal Products, Inc., 1526 Lincoln Avenue, Utica, NY 13502, on or about 12/10/2025; A Drop Hammer Press Operator was exposed to a continuous noise level at a 220.3% dose of the OSHA permissible exposure limit (PEL). The equivalent dBA is approximately 93.70 dBA calculated as the 8-hour time weighted sound pressure level for a sampling period of 468 minutes. A zero increment was used for the 12 minutes not sampled. Employee was wearing Laser Lite Earplug LL30G/6XF60 (NRR 32) hearing protection. The employer did not administer a continuing, effective hearing conservation program.  c) Utica Metal Products, Inc., 1526 Lincoln Avenue, Utica, NY 13502, on or about 12/10/2025; A Drop Hammer Press Operator was exposed to a continuous noise level at a 283.8% dose of the OSHA permissible exposure limit (PEL). The equivalent dBA is approximately 95.52 dBA calculated as the 8-hour time weighted sound pressure level for a sampling period of 468 minutes. A zero increment was used for the 12 minutes not sampled. Employee was wearing Moldex 6900 Corded Disposable Foam Earplugs (NRR 33) hearing protection. The employer did not administer a continuing, effective hearing conservation program.  Abatement certification is required

29 CFR  1910.95(g)(8)(ii): The employer did not ensure that the following steps outlined in 1910.95(g)(8)(ii)(A)-(D) were taken when a standard threshold shift occurred; (A) Employees not using hearing protectors shall be fitted with hearing protectors, trained in their use and care, and required to use them.  (B) Employees already using hearing protectors shall be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary.  (C) The employee shall be referred for a clinical audiological evaluation or an otological examination, as appropriate, if additional testing is necessary or if the employer suspects that a medical pathology of the ear is caused or aggravated by the wearing of hearing protectors.  (D) The employee is informed of the need for an otological examination if a medical pathology of the ear that is unrelated to the use of hearing protectors is suspected:   a) Utica Metal Products, Inc., 1526 Lincoln Avenue, Utica, NY 13502, on or about 11/13/2025; The employer did not ensure that steps outlined in 1910.95(g)(8)(ii)(A)-(D) were taken when a standard threshold shift occurred, including but not limited to; failing to ensure employees were refitted with hearing protectors, failing to ensure employees were retrained in the use of hearing protectors, failing to refer the employees for a clinical audiological evaluation or an otological examination as appropriate, and failing to inform the employees of the need for an otological examination if a medical pathology of the ear that is unrelated to the use of hearing protectors is suspected.
