29 CFR 1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv): a) Mezzanine Tire Chute: On or about September 25, 2025, employees utilizing the tire chute to retrieve tires from the mezzanine were exposed to fall hazards in excess of ten (10) feet from the lower level due to an incomplete guard rail system. b) Mezzanine Tire Rack: On or about September 25, 2025, employees utilizing the tire rack to retrieve tires from the mezzanine were exposed to fall hazards in excess of ten (10) feet from the lower level due to an incomplete guard rail system. Abatement certification required.

29 CFR 1910.133(a)(3): The employer did not ensure that each affected employee who wore prescription lenses while engaged in operations that involved eye hazards wore eye protection that incorporated the prescription in its design, or wore eye protection that could be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses: a) On or about September 25, 2025, an employee who wears prescription lenses did not wear any form of eye protection such as safety glass with the prescription built in or safety glasses that fit over their prescription lenses.
